ARTICLE 4: EDUCATIONAL SERVICES AND PLATFORM ACCESS

MASTI MANCH INDIA provides educational services through recorded courses, live classes, workshops, assessments, competitions, mentoring programs, certification programs, artificial intelligence tools, educational resources and other learning solutions.

Access to the Platform is granted as a limited, revocable, non-exclusive, non-transferable and non-commercial license solely for personal educational use and subject to continued compliance with these Terms.

Nothing contained in these Terms shall transfer ownership of any content, technology, intellectual property or platform assets to Users.

The Platform may continuously develop, modify, improve, suspend, discontinue or replace any feature, functionality, course, instructor, AI system, educational resource or service offered through the Platform.

The Platform does not guarantee the continued availability of any specific course, instructor, feature or educational offering and reserves the right to make changes where reasonably necessary for educational, legal, operational, commercial or technological reasons.

Where any educational offering is described as providing "lifetime access", such access shall mean access for the commercial life of the relevant course on the Platform and shall not be interpreted as access for the lifetime of the User.

ARTICLE 5: ACCEPTABLE USE OF THE PLATFORM

Users shall not engage in any conduct that interferes with the operation of the Platform, damages the reputation of the Platform, infringes intellectual property rights, violates applicable laws or compromises the safety and security of users.

By providing contact information to the Platform, Users expressly consent to receiving educational, operational, administrative, compliance-related and security-related communications through such channels.

Users acknowledge that communications transmitted through registered contact details shall constitute valid notice for the purposes of platform operations, account administration, service delivery, policy updates, payment matters, support communications and legal compliance.

Users are responsible for ensuring that their contact information remains accurate and current at all times. Failure to update contact information shall not invalidate communications properly transmitted by the Platform.

ARTICLE 7: MODIFICATIONS TO THE PLATFORM

The Platform operates within a dynamic technological and educational environment. Accordingly, MASTI MANCH INDIA reserves the right to modify, enhance, update, suspend or discontinue any aspect of the Platform at any time.

No User shall acquire any vested right in the continued availability of any specific feature, functionality or educational service merely because such feature was previously available.

ARTICLE 8: INTELLECTUAL PROPERTY RIGHTS

MASTI MANCH INDIA invests substantial time, effort, expertise and financial resources in developing its educational content, technology infrastructure, artificial intelligence systems, learning methodologies, brand assets and digital services. Accordingly, all rights, title and interest in and to the Platform and its contents shall remain the exclusive property of MASTI MANCH INDIA and its licensors.

The Platform, including its courses, recorded lectures, live classes, notes, study materials, assessments, question banks, presentations, software, source code, databases, AI systems, algorithms, educational methodologies, graphics, user interfaces, trademarks, logos, trade names, domain names and all associated intellectual property rights, is protected under applicable copyright, trademark, trade secret and other intellectual property laws.

Access to the Platform grants Users only a limited right to access educational content in accordance with these Terms. No ownership rights, commercial rights, intellectual property rights or licensing rights are transferred to Users by virtue of platform access, enrollment, subscription or payment of fees.

Any unauthorized use, reproduction, distribution, modification, publication, commercialization or exploitation of Platform content shall constitute a material breach of these Terms and may result in immediate legal action.

ARTICLE 9: USER CONTENT AND SUBMISSIONS

The Platform may permit Users to submit assignments, projects, questions, comments, reviews, testimonials, feedback, competition entries, educational materials and other content in connection with educational activities.

Users retain ownership of content originally created by them. However, by submitting content to the Platform, Users grant MASTI MANCH INDIA a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to host, store, process, reproduce, display, distribute, evaluate and utilize such content for educational, operational, compliance, security and platform-improvement purposes.

Such technologies may include AI tutors, AI teaching assistants, conversational learning systems, recommendation engines, adaptive learning systems, automated assessments, AI-generated summaries, AI-generated practice questions and future AI-enabled educational technologies.

Users acknowledge that AI systems are designed to assist learning and educational engagement and are not intended to replace professional legal, tax, medical, financial or other regulated professional advice.

While reasonable efforts are made to improve AI performance, the Platform does not guarantee that AI-generated outputs shall always be accurate, complete, current or error-free. Users remain responsible for independently verifying important information before relying upon AI-generated responses.

The Platform reserves the right to modify, improve, suspend, replace or discontinue AI services at any time in response to technological, operational, legal or business considerations.

ARTICLE 11: AI TRAINING AND MODEL PROTECTION

The artificial intelligence systems, prompts, workflows, datasets, training methodologies, recommendation engines, educational models and related technologies used by MASTI MANCH INDIA represent valuable proprietary assets.

Users shall not use Platform content, AI outputs, educational materials, prompts, datasets, metadata, course structures or platform interactions for the purpose of training, fine-tuning, developing, benchmarking or improving artificial intelligence systems without the prior written consent of MASTI MANCH INDIA.

Users shall not attempt to extract, replicate, reverse engineer, reconstruct, analyze or imitate the operation, architecture, behavior or functionality of any AI system deployed by the Platform.

Any attempt to build competing AI systems using Platform resources, outputs or content shall constitute a material breach of these Terms and may result in immediate suspension, termination and legal proceedings.

ARTICLE 12: ANTI-PIRACY AND CONTENT PROTECTION

The educational content available through the Platform constitutes valuable intellectual property and is made available solely for authorized educational purposes.

Users shall not copy, download, record, reproduce, distribute, publish, upload, transmit, sell, rent, sublicense, share or otherwise exploit Platform content except as expressly authorized by the Platform.

MASTI MANCH INDIA invests substantial resources in creating and maintaining educational databases, learning resources, AI systems and proprietary digital infrastructure. Users may access the Platform only through interfaces and methods expressly authorized by the Platform.

Users shall not use bots, crawlers, spiders, scrapers, automated extraction tools, indexing tools, dataset generation tools or similar technologies to access, collect, reproduce, monitor, harvest or extract Platform content without prior written authorization.

Users shall not engage in systematic collection of educational materials, user data, AI outputs, metadata, pricing information, course structures or platform content for commercial, competitive or technological purposes.

The Platform reserves the right to implement technical measures designed to detect, restrict and prevent unauthorized automated access.

ARTICLE 14: REVERSE ENGINEERING RESTRICTIONS

The software systems, applications, databases, APIs, AI systems, educational technologies and technical infrastructure of MASTI MANCH INDIA are proprietary and confidential.

Prohibited activities include unauthorized access attempts, credential theft, malware distribution, vulnerability exploitation, denial-of-service attacks, phishing, account takeover attempts, interference with security controls and other activities that threaten platform integrity.

The Platform may implement security monitoring systems, fraud detection systems, authentication controls, access restrictions, rate limiting mechanisms, threat detection tools and other protective measures necessary to maintain security.

Users acknowledge that the Platform may investigate security incidents and cooperate with regulatory authorities, law enforcement agencies, cybersecurity professionals and service providers where reasonably necessary.

ARTICLE 16: WEBSITE INFRASTRUCTURE AND PLATFORM RESOURCES

The Platform's infrastructure, servers, databases, networks, content delivery systems, storage systems, AI resources and computing resources are intended solely for legitimate educational use.

Users shall not engage in conduct that unreasonably consumes, interferes with or disrupts Platform resources. Activities designed to overload systems, generate excessive traffic, interfere with educational services or degrade platform performance are strictly prohibited.

The Platform may impose reasonable limitations relating to bandwidth usage, storage utilization, API access, concurrent sessions, AI usage limits and other technical resources where necessary to ensure fair and secure operation.

The Platform reserves the right to restrict, suspend or terminate access where user activity poses a threat to platform stability, security, availability or lawful operations.

ARTICLE 17: MONITORING, ENFORCEMENT AND INVESTIGATIONS

To protect users, educational services and platform infrastructure, MASTI MANCH INDIA may monitor platform activity, investigate suspected violations and maintain records relating to security events, system activity and compliance matters.

Where the Platform reasonably believes that a violation of these Terms has occurred, it may take action including issuing warnings, restricting functionality, suspending accounts, terminating access, preserving evidence, initiating legal proceedings or reporting unlawful activity to appropriate authorities.

Nothing contained in these Terms shall limit the Platform's right to protect its intellectual property, educational content, technology systems, business interests, users or reputation through lawful means.

ARTICLE 18: COURSES, SUBSCRIPTIONS AND DIGITAL SERVICES

MASTI MANCH INDIA offers educational services through recorded courses, live classes, workshops, certification programs, competitions, assessments, mentoring programs, subscription plans, artificial intelligence learning tools and other educational products that may be introduced from time to time.

Access to any course, program, subscription or educational service is granted solely for personal educational purposes and subject to continued compliance with these Terms and any additional program-specific conditions communicated by the Platform.

The Platform reserves the right to modify course structures, learning pathways, curriculum content, teaching methodologies, instructors, assessment frameworks, certification requirements, AI tools and educational resources where reasonably necessary for educational quality, technological advancement, legal compliance or operational efficiency.

Enrollment in any course or subscription grants only a limited right to access the educational services purchased and shall not create any ownership interest in the underlying content, technology or intellectual property of the Platform.

The Platform may introduce, modify, suspend or discontinue any educational service at its sole discretion and shall not be liable merely because a particular course, instructor, feature or program is no longer offered.

ARTICLE 19: FEES, PRICING AND TAXES

Fees for courses, subscriptions, certifications, workshops, assessments and other services shall be displayed on the Platform or otherwise communicated to Users at the time of purchase.

All pricing displayed by the Platform may be revised from time to time in response to market conditions, operational requirements, promotional campaigns, taxation changes, technological developments or business considerations. Any pricing changes shall not ordinarily affect purchases already completed unless otherwise expressly stated.

Applicable taxes, including Goods and Services Tax (GST), shall be charged in accordance with applicable laws. Users shall be responsible for payment of all applicable taxes, duties, levies and governmental charges associated with their purchases.

The Platform reserves the right to correct pricing errors, calculation errors, technical errors, discount errors or system generated inaccuracies at any time, including after an order has been placed, provided such corrections are made in good faith.

Where an obvious pricing error exists that would have been apparent to a reasonable person, the Platform may cancel the affected transaction and refund the amount received.

Payments for educational services may be processed through third-party payment gateways, banks, financial institutions, digital wallets, UPI systems, card networks and other authorized payment service providers.

By submitting payment information, Users represent and warrant that they are legally authorized to use the payment method selected and that all information provided is accurate and complete.

The Platform does not control the operation of payment gateways or banking systems and shall not be responsible for delays, failures, interruptions, reversals, processing errors or technical issues attributable to such third parties.

Users acknowledge that payment processing may be subject to additional terms and conditions imposed by payment service providers.

The Platform reserves the right to verify transactions, delay access pending payment confirmation, request additional verification information or refuse transactions where fraud, misuse or security concerns are reasonably suspected.

ARTICLE 21: SUBSCRIPTION SERVICES

Subscription plans may be offered on monthly, quarterly, annual or other recurring billing cycles as determined by the Platform.

Where a subscription includes automatic renewal, such renewal shall occur in accordance with the terms disclosed at the time of purchase unless cancelled by the User before the applicable renewal date.

Users are responsible for reviewing subscription details, renewal dates, billing frequencies and applicable charges before completing a purchase.

The Platform reserves the right to modify subscription structures, features, pricing, access levels or benefits upon reasonable notice to Users.

Cancellation of future renewals shall not automatically entitle a User to a refund for amounts already paid unless expressly provided in the Refund Policy or required by applicable law.

ARTICLE 22: REFUNDS AND CANCELLATIONS

Refunds, cancellations and withdrawal requests shall be governed by the separate Refund and Cancellation Policy published by MASTI MANCH INDIA from time to time.

Users are encouraged to review course descriptions, syllabus details, demonstration content, instructor information and program specifications before making purchases.

Unless otherwise expressly stated in the Refund Policy or required by applicable law, educational services delivered through digital platforms may not be eligible for refunds after access has been granted.

Dissatisfaction with learning style, teaching methodology, personal expectations, study habits, examination performance or subjective educational outcomes shall not by itself create a right to a refund.

The Platform reserves the right to refuse refund requests that are fraudulent, abusive, repetitive or inconsistent with the applicable Refund Policy.

Nothing in these Terms shall limit refund rights that cannot lawfully be excluded under applicable consumer protection laws.

ARTICLE 23: PROMOTIONAL OFFERS, SCHOLARSHIPS AND DISCOUNTS

Users participating in affiliate or referral programs shall comply with applicable advertising laws, disclosure requirements, consumer protection regulations and platform policies.

Nothing contained in these Terms shall guarantee continued availability of any referral, affiliate or incentive program.

ARTICLE 25: CHARGEBACKS AND PAYMENT DISPUTES

Users agree to first contact the Platform in good faith to resolve payment-related concerns before initiating chargebacks, payment reversals or payment disputes through financial institutions.

Where a User initiates a chargeback, reversal or payment dispute after receiving access to educational services without valid legal grounds, the Platform may suspend or terminate access pending resolution of the dispute.

The Platform reserves the right to recover unpaid fees, chargeback costs, payment gateway penalties, collection expenses, administrative costs and legal expenses arising from fraudulent or unjustified chargebacks.

Nothing contained herein shall restrict a User's rights under applicable consumer protection laws or financial regulations.

ARTICLE 26: CERTIFICATES, ACHIEVEMENTS AND EDUCATIONAL CREDENTIALS

The Platform may issue certificates, completion records, badges, rankings, participation acknowledgements or other educational credentials based upon criteria determined by the Platform.

Issuance of certificates may be subject to attendance requirements, assessment performance, project completion, academic integrity standards, fee payment requirements or other educational criteria.

Certificates issued by MASTI MANCH INDIA constitute evidence of participation or completion of educational activities conducted by the Platform and shall not automatically constitute government-recognized qualifications, university degrees, professional licenses or statutory certifications unless expressly stated otherwise.

The Platform reserves the right to suspend, revoke or cancel certificates obtained through fraud, impersonation, academic misconduct, examination malpractice or violation of these Terms.

ARTICLE 27: CONSUMER RIGHTS AND FAIR DEALING

MASTI MANCH INDIA is committed to providing educational services in a fair, transparent and responsible manner.

Nothing contained in these Terms shall exclude, restrict or waive any rights that cannot lawfully be excluded under applicable consumer protection laws.

The Platform shall endeavor to administer enrollments, subscriptions, refunds, educational services and user interactions in good faith and in a manner reasonably consistent with applicable legal requirements.

Users acknowledge that educational services involve subjective learning experiences and that individual outcomes may vary based upon effort, aptitude, attendance, engagement, prior knowledge and numerous other factors beyond the Platform's control.

Accordingly, dissatisfaction with educational outcomes shall not automatically constitute a deficiency of service.

ARTICLE 28: COMMUNITY STANDARDS AND USER CONDUCT

MASTI MANCH INDIA seeks to maintain a safe, respectful and productive learning environment for students, parents, teachers and all other users. Every user is expected to interact with the Platform and with other users in a professional, courteous and responsible manner.

Users shall not engage in conduct that is abusive, threatening, discriminatory, defamatory, obscene, offensive, unlawful or otherwise inconsistent with the educational objectives of the Platform. Harassment, bullying, intimidation, hate speech, stalking, impersonation, academic misconduct and disruptive behavior are strictly prohibited.

Users are expected to respect differences of opinion and to participate constructively in discussions, assessments, competitions, workshops, webinars, live classes and community forums. The Platform reserves the right to moderate discussions, remove content, restrict participation or suspend access where conduct is inconsistent with these standards.

Repeated violations of community standards may result in permanent suspension from the Platform without prejudice to any other remedies available under law.

ARTICLE 29: USER REVIEWS, RATINGS AND FEEDBACK

The Platform may permit users to submit reviews, ratings, testimonials, comments, suggestions and other forms of feedback relating to educational services, instructors, courses or platform experiences.

Users are encouraged to provide honest, accurate and constructive feedback based upon genuine experiences. Reviews and ratings must not contain false statements, misleading information, personal attacks, abusive language, confidential information or unlawful content.

By submitting reviews or feedback, users grant MASTI MANCH INDIA a perpetual, worldwide, royalty-free, transferable and sublicensable right to use, reproduce, publish, display, distribute and otherwise utilize such feedback for educational, operational, promotional and business purposes.

The Platform reserves the right to review, moderate, edit, remove or decline publication of reviews where necessary to comply with legal requirements, maintain platform integrity or protect users from harmful content.

Nothing in this Article shall prevent users from expressing lawful and genuine opinions based on actual experiences.

ARTICLE 30: TESTIMONIALS, SUCCESS STORIES AND ACHIEVEMENTS

Users may voluntarily submit testimonials, academic achievements, project outcomes, competition results, certification milestones and similar accomplishments for publication or recognition.

Where users voluntarily provide such information, the Platform may publish, display, reproduce, distribute and promote such achievements through websites, applications, social media channels, marketing materials, investor presentations, educational campaigns and other legitimate business activities.

The Platform may make reasonable editorial modifications relating to grammar, formatting, length, clarity or presentation while preserving the overall substance of the content.

Where legally required, additional consent may be obtained before using photographs, videos or information relating to minors for promotional purposes.

Users may request discontinuation of future promotional use of voluntarily submitted content, subject to legal obligations, prior publications and operational limitations.

ARTICLE 31: PHOTOGRAPHS, VIDEOS AND RECORDINGS

Recorded content may be used for creating educational materials, improving instructional quality, supporting absent students, maintaining records, resolving disputes, training instructors and enhancing educational services.

Users acknowledge that names, profile information, voices, images, chat messages, questions, answers and classroom participation may incidentally appear in recordings. Such incidental appearances shall not give rise to claims against the Platform where recordings are used for legitimate educational, operational or promotional purposes.

Additional safeguards may be implemented for recordings involving minor students in accordance with applicable laws and child protection requirements.

Users participate in such unofficial communities entirely at their own risk.

ARTICLE 33: BRAND ASSETS AND TRADEMARK PROTECTION

The name "MASTI MANCH INDIA", together with associated logos, trademarks, service marks, slogans, branding elements, trade dress, domain names, visual identities and marketing materials, constitutes valuable intellectual property belonging exclusively to MASTI MANCH INDIA.

Users shall not use Platform trademarks or branding elements in any manner likely to create confusion regarding sponsorship, endorsement, affiliation or authorization.

Users shall not register domain names, social media handles, business names, trademarks or digital assets that are identical or confusingly similar to the Platform's branding.

Any unauthorized use of Platform trademarks or brand assets may result in legal proceedings, injunctive relief, recovery of damages and other remedies available under applicable law.

ARTICLE 34: REPUTATION AND GOODWILL PROTECTION

MASTI MANCH INDIA has invested substantial effort and resources in developing its reputation, goodwill and educational standing. Users agree not to knowingly engage in conduct intended to damage the reputation, credibility or goodwill of the Platform through false statements, impersonation, malicious campaigns, misinformation or fraudulent conduct.

Nothing contained in these Terms shall restrict lawful criticism, fair comment, honest reviews or legitimate expressions of opinion based upon actual experiences. However, users remain responsible for ensuring that public statements are truthful, lawful and not misleading.

The Platform reserves the right to pursue legal remedies against persons who knowingly engage in defamatory conduct, impersonation, fraudulent representations or unlawful attacks upon its reputation, personnel, instructors or business operations.

ARTICLE 35: MEDIA, PUBLIC STATEMENTS AND PRESS RELATIONS

Only persons expressly authorized by MASTI MANCH INDIA may make official statements on behalf of the Platform.

Users, students, teachers, affiliates and community members shall not represent themselves as official spokespersons or authorized representatives of the Platform unless expressly authorized in writing.

Any media inquiries relating to Platform operations, educational programs, business activities, strategic initiatives, partnerships or legal matters should be directed through official communication channels designated by the Platform.

The Platform reserves the right to respond to inaccurate public statements, media reports, online publications or other communications affecting its legal rights, business interests, educational activities or reputation.

ARTICLE 36: ADVERTISING, SPONSORSHIPS AND THIRD-PARTY PROMOTIONS

From time to time, the Platform may display advertisements, sponsorships, educational partnerships, affiliate promotions, corporate collaborations or other commercial communications.

The appearance of third-party advertisements or promotions does not necessarily constitute endorsement, recommendation or guarantee by MASTI MANCH INDIA.

Users acknowledge that interactions with advertisers, sponsors, vendors, partners or third parties are undertaken directly between the user and the relevant third party.

Except to the extent required by applicable law, the Platform shall not be responsible for products, services, representations, warranties or conduct of third-party advertisers, sponsors or promotional partners.

ARTICLE 37: USER PARTICIPATION IN EVENTS, COMPETITIONS AND PUBLIC PROGRAMS

The Platform may organize educational competitions, hackathons, challenges, scholarship programs, public events, exhibitions, workshops, seminars, award ceremonies and similar initiatives.

Participation in such activities may require compliance with additional rules, eligibility criteria, evaluation standards and event-specific requirements communicated by the Platform.

Users grant the Platform the right to publish names, rankings, achievements, project summaries, certificates, awards and other event-related information where reasonably necessary for administration, recognition, educational promotion and record-keeping purposes.

The Platform reserves the right to disqualify participants, withhold awards or revoke recognition where fraud, misconduct, academic dishonesty or violation of applicable rules is identified.

ARTICLE 38: DISCLAIMERS AND NO GUARANTEE OF RESULTS

MASTI MANCH INDIA endeavors to provide high-quality educational services, reliable technology and meaningful learning experiences. However, educational outcomes depend upon numerous factors beyond the Platform's control, including individual aptitude, prior knowledge, effort, attendance, discipline, participation, learning style and external circumstances.

Accordingly, the Platform does not guarantee examination success, academic performance, admission to educational institutions, professional certification, employment opportunities, business success, income generation, career advancement or achievement of any specific educational objective.

All educational content, AI-generated outputs, assessments, recommendations, learning resources and related services are provided on an "as available" and "as is" basis, subject to applicable law.

While reasonable efforts are made to maintain accuracy and reliability, the Platform does not warrant that educational content, AI outputs, technological systems, communications or services shall always be uninterrupted, error-free, complete, current or suitable for every individual purpose.

Users are encouraged to independently evaluate educational information and to seek professional advice where specialized expertise is required.

ARTICLE 39: LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, MASTI MANCH INDIA, its partners, employees, instructors, consultants, affiliates, licensors, technology providers and representatives shall not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising out of or relating to use of the Platform.

Without limiting the foregoing, the Platform shall not be liable for loss of profits, loss of opportunity, loss of educational opportunities, loss of business, loss of goodwill, loss of data, interruption of services, emotional distress, reputational harm or other consequential losses.

Where liability cannot be excluded under applicable law, the aggregate liability of MASTI MANCH INDIA arising from or relating to the Platform, educational services or these Terms shall not exceed the total amount actually paid by the User to the Platform during the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing contained herein shall exclude liability that cannot lawfully be excluded under applicable law.

ARTICLE 40: USER INDEMNITY

Users agree to defend, indemnify and hold harmless MASTI MANCH INDIA, its partners, employees, instructors, consultants, service providers, affiliates, licensors and representatives from and against any claims, proceedings, liabilities, damages, losses, penalties, costs and expenses arising from or relating to:

the User's violation of these Terms;

the User's violation of applicable laws;

the User's infringement of intellectual property rights;

the User's misuse of educational content or platform services;

the User's submissions, communications or activities on the Platform;

fraudulent, unlawful or negligent conduct attributable to the User.

The indemnity obligations contained in this Article shall include reasonable legal fees, investigation costs, expert fees, cybersecurity expenses, enforcement costs and settlement expenses incurred by the Platform.

ARTICLE 41: SUSPENSION AND TERMINATION

The Platform reserves the right to suspend, restrict or terminate access to the Platform where reasonably necessary to protect users, educational services, intellectual property, business operations or legal interests.

Without limitation, suspension or termination may occur where a User:

violates these Terms;

engages in piracy or unauthorized content distribution;

misuses AI systems;

commits academic misconduct;

provides false information;

engages in fraud;

compromises security;

harasses other users;

fails to comply with applicable laws or platform policies.

Depending upon the circumstances, the Platform may issue warnings, restrict functionality, suspend accounts, revoke access, cancel subscriptions, withdraw certifications or permanently terminate user access.

Termination of access shall not affect accrued rights, payment obligations, intellectual property protections, indemnity obligations, dispute resolution provisions or any provisions intended to survive termination.

ARTICLE 42: FORCE MAJEURE

MASTI MANCH INDIA shall not be liable for delays, interruptions, failures or inability to perform obligations arising from circumstances beyond its reasonable control.

Such circumstances may include natural disasters, floods, earthquakes, fires, epidemics, pandemics, war, terrorism, civil unrest, labor disputes, governmental actions, internet failures, telecommunications disruptions, power outages, cybersecurity incidents, denial-of-service attacks, cloud infrastructure failures or other events beyond reasonable control.

Where a Force Majeure event occurs, the Platform may suspend services, modify operations, reschedule activities, implement alternative arrangements or take other reasonable measures necessary to continue educational services.

Force Majeure events shall not automatically entitle Users to refunds, compensation or damages unless otherwise required by applicable law.

ARTICLE 43: DISPUTE RESOLUTION AND ARBITRATION

MASTI MANCH INDIA believes that disputes should be resolved efficiently, fairly and in good faith.

In the event of any dispute, controversy or claim arising out of or relating to the Platform, educational services, AI systems, intellectual property, privacy matters, subscriptions, payments or interpretation of these Terms, the parties shall first attempt to resolve the matter through good-faith discussions and negotiations.

If the dispute remains unresolved for a period of thirty (30) days from written notice of the dispute, either party may refer the matter to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 and any statutory modifications thereto.

The arbitration shall be conducted by a Sole Arbitrator mutually appointed by the parties. If the parties are unable to agree upon the appointment of an Arbitrator, the appointment shall be made in accordance with applicable law.

The seat and venue of arbitration shall be Gandhinagar, Gujarat, India.

The arbitration proceedings shall be conducted in the English language.

Nothing contained in this Article shall prevent MASTI MANCH INDIA from seeking interim relief, injunctions, intellectual property protection orders, anti-piracy orders, cybersecurity protection orders or other urgent remedies before courts of competent jurisdiction.

Nothing contained herein shall restrict rights available under applicable consumer protection laws.

ARTICLE 44: GOVERNING LAW, NOTICES AND ELECTRONIC RECORDS

These Terms shall be governed by and construed in accordance with the laws of India.

Subject to the arbitration provisions contained herein, the courts located at Gandhinagar, Gujarat, India shall have exclusive jurisdiction over matters arising from or relating to the Platform and these Terms.

The Platform may provide notices, communications, disclosures and legal information through email, SMS, WhatsApp, platform notifications, mobile applications, website announcements or other reasonable electronic means.

Users acknowledge and agree that electronic communications shall constitute valid and effective notice for legal and operational purposes.

By creating an account, enrolling in courses, purchasing services, clicking acceptance buttons, providing OTP verification, using digital signatures, utilizing Aadhaar-based authentication or otherwise interacting electronically with the Platform, Users consent to the use of electronic records, electronic communications and electronic agreements.

Electronic records maintained by the Platform shall be admissible as evidence to the fullest extent permitted under applicable law.

ARTICLE 45: GENERAL PROVISIONS

These Terms, together with the Privacy Policy, Refund Policy, Child Safety Policy, AI Usage Policy, Student Agreement and other policies published by MASTI MANCH INDIA, constitute the entire agreement between the User and the Platform relating to use of the Platform.

If any provision of these Terms is determined to be invalid, unlawful or unenforceable, such determination shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

Failure by the Platform to enforce any provision shall not constitute a waiver of its rights.

The Platform may assign, transfer or delegate its rights and obligations under these Terms in connection with restructuring, succession, merger, acquisition, business transfer, investment transactions or similar corporate events. Users may not assign their rights or obligations without prior written consent of the Platform.

Nothing contained in these Terms shall create any employment relationship, agency relationship, partnership, joint venture or fiduciary relationship between the Platform and any User.

These Terms are drafted in the English language. In the event of any translation, the English version shall prevail to the fullest extent permitted by law.

USER ACKNOWLEDGEMENT

BY ACCESSING, REGISTERING ON, ENROLLING THROUGH, PURCHASING FROM OR OTHERWISE USING THE PLATFORM, THE USER ACKNOWLEDGES AND AGREES THAT:

THE USER HAS READ THESE TERMS OF USE IN THEIR ENTIRETY;

THE USER UNDERSTANDS THE RIGHTS, OBLIGATIONS AND RESPONSIBILITIES CONTAINED HEREIN;

THE USER AGREES TO BE LEGALLY BOUND BY THESE TERMS;

THE USER HAS REVIEWED OR HAS HAD THE OPPORTUNITY TO REVIEW THE PLATFORM'S RELATED POLICIES;

THE USER CONSENTS TO THE USE OF ELECTRONIC RECORDS, ELECTRONIC COMMUNICATIONS AND DIGITAL ACCEPTANCE MECHANISMS;

THE USER AGREES TO USE THE PLATFORM RESPONSIBLY, LAWFULLY AND IN ACCORDANCE WITH THESE TERMS.
